Is private property towing legal in Texas?

Yes, when done right. The Texas Towing and Booting Act (Occupations Code Ch. 2308) requires a written agreement between property owner and tow company, state-compliant signage at every entry, the required notice before towing, and specific release procedures. Every step gets documented in writing before enforcement starts.

Do you work with HOAs?

Yes. HOAs are the most common private-property client. The enforcement operator audits the existing signage, updates the parking rules with the board, and sets a patrol schedule that fits the community. Board members do not make the call, dispatchers do, per the agreed rules. That keeps the board out of personal liability.

Can I call to tow a specific car in my lot?

If there is a signed property management agreement, yes. The property manager, or a designated contact, calls dispatch, confirms the vehicle and the violation, and the operator responds. Without an agreement on file, no legal tow can happen from that property.

What if a resident forgets their permit and gets towed?

They pay the release fee at the vehicle storage facility and get the car back, with full paperwork. It is rare, tows happen only after the required wait time and sign check. If a resident calls in a good-faith mistake, releases are handled professionally and documented. Property managers can also preauthorize per-vehicle exceptions.

Is there a cost to the property?

Usually the vehicle owner pays. Dallas City Code 48A-43 caps a non-consent tow at $121 for vehicles under 10,000 lbs, $191 up to 26,000 lbs, and $445 above that, billed when the driver retrieves the car. How your property's agreement is structured, including any specialty services like event enforcement, gets set in writing before enforcement starts.
